QUAKER STEAK & LUBE® Revved-Up Rewards™ RULES

Quaker Steak & Lube® Franchising Corp. ("Quaker Steak & Lube® ," "we" or "us") started its Quaker Steak & Lube® Revved-Up Rewards™ program (the “Program”) to recognize and reward our most loyal Quaker Steak & Lube® restaurant Guests. We offer the Program at participating Quaker Steak & Lube® restaurants in the United States. If you want to take advantage of the prodigious benefits ("Rewards") that we offer to members of the Program, then you must agree to these terms and conditions (the “Rules”).

ELIGIBILITY

You may enroll in the Program if: (a) you are a legal resident of the United States, (b) you are at least 18 years of age at the time you enroll, (c) you have a postal address that the United States Postal Service recognizes, (d) you have an active e-mail address, (e) you have an active telephone number (land line or mobile), and (f) you are a human being. Only individual persons may enroll in the Program. No corporations, partnerships, limited liability companies, trusts, or other legal entities may enroll. Quaker Steak & Lube® Employees and Franchisees, along with their spouses and children who occupy the same household, are not eligible to be Program members.

ENROLLING

To enroll in the Program, pick up a Quaker Steak & Lube® Revved-Up Rewards Card (“Program Card”) at a participating Quaker Steak & Lube® restaurant, That Program Card (or your telephone number) identifies you as a Program Member. You must register your Program Card on-line at TheLube.com/rewards ("Website") before you can redeem any Rewards. In some cases, you may not be able to earn any credits until the Program Card has been registered. In some cases, it may take our computer system up to 24 hours after you enroll in our Program to recognize that you have a Reward that you may redeem. Ability to earn Rewards may be delayed 24 hours as a result.

Program Enrollment is simple:

  1. Go to TheLube.com/rewards and follow the prompts. Under "New User", click the "Sign Up" button.
  2. If you’ve already picked up a Program Card, enter your Program Card number and click submit. If you have not picked up your Program Card, you may come back to this site and enter your Program Card number when you have a Program Card. You can pick-up a Program Card from participating Quaker Steak & Lube® restaurants.
  3. You may also sign up as a Digital user without a physical Program card. Go to TheLube.com/Rewards and follow the prompts. Under "New User", click the "Sign Up" button. Then leave the Card Number field blank and click ‘Submit’
  4. Complete the designated fields on the registration form. Click ‘Submit’
  5. Sit back, relax, and go get earning!

From time to time, we may use your contact information to update you, only in the ways you have opted-into when you enrolled in the Program. You may choose to opt-out of Program messaging at any time. If your contact information changes, or if you wish to change your contact information, you may log onto TheLube.com/rewards using your username/password to update your contact information and/or preferences.

At our sole discretion and without warning, we reserve the right to block you from enrolling in the Program or remove you from the Program if any information provided to us is inaccurate, untruthful, or incomplete.

Each person may register for only one Quaker Steak & Lube®  Program Card and/or Digital Card Series and have only one Program account.  Membership may be suspended or terminated if Quaker Steak & Lube®  determines any person has registered more than one Quaker Steak & Lube®  Program Card and/or Digital Card Series or holds more than one Program account. In this case, Quaker Steak & Lube® may deactivate all active, associated Program Cards and/or Digital Card Series you have registered and cancel all Program accounts you have created.  Quaker Steak & Lube®  may also refuse to allow you to re-enroll in the Program or re-register any Program Card and/or Digital Card Series.

There is no fee associated with enrolling in the Quaker Steak & Lube® Program, nor is there a fee to remain in the Program.

Quaker Steak & Lube®  has the right to terminate the Program in its entirety without cause or warning in its sole discretion.  Quaker Steak & Lube®  maintains the right to cancel any membership in the Program in its sole discretion.  Quaker Steak & Lube® may limit the amount of members allowed to sign up for the Program.

COMMUNICATION

As a part of the Program, Quaker Steak & Lube® may send to you or call you with informational and marketing messages to the contact information that you provide as part of your registration, such as messages informing you of improvements we make to the Quaker Steak & Lube® Program, new Rewards you may earn, Rewards you have earned that may be ready to expire, new menu items you may want to try, seasonal promotions you may want to enjoy, and events happening in Quaker Steak & Lube® restaurants.

Contacting You by E-mail and Postal Mail

As a condition of enrolling in the Quaker Steak & Lube® Program, you agree that Quaker Steak & Lube® may send you marketing and informational messages by e-mail and postal mail to the e-mail address and to the postal address associated with your Quaker Steak & Lube® Revved-Up Rewards Program account ("Program Account"). If at any time you no longer wish to receive such marketing and informational messages, you may choose to opt-out/unsubscribe of email communications only. If you wish to cancel your Program Account, you may also do that separately as described below in the Membership Termination section of the Rules. Please note that if you opt-out/unsubscribe from the Program email list, Quaker Steak & Lube® will not de-activate your Program Card and/or Digital Account. Unsubscribing from email communications will not cause you to forfeit any Rewards, credits, and other benefits of being a Quaker Steak & Lube® Program Member that you may have earned. If you opt-out of the Program, only then will forfeit all Rewards, credits, and other benefits of being a Quaker Steak & Lube® Program Member that you may have earned.

Contacting You on Your Mobile Telephone Number

By registering for Revved-Up Rewards, you are opting in to receive autodialed and prerecorded informational and telemarketing calls however, Quaker Steak & Lube® will not send you autodialed and prerecorded informational and telemarketing calls at this time. We reserve the right to do so in the future. By providing us your mobile telephone number, you represent that you are the owner of the mobile telephone associated with that mobile telephone number and that you are responsible for controlling access to that mobile telephone. You agree to notify Quaker Steak & Lube® of any change to your mobile telephone number. If change your mobile telephone number, you agree that Quaker Steak & Lube® may continue to send autodialed and prerecorded calls to you at the new mobile telephone number. Depending on the terms of your service agreement with your mobile telecommunications service provider ("TSP"), voice, message, and data charges may apply to the autodialed and prerecorded calls that Quaker Steak & Lube® sends to your mobile telephone number.

PRIVACY

We will use the information you provide us when you enroll and when you update your information. We will not share, sell, or otherwise distribute any of your information to any party outside of Quaker Steak. It is your responsibility to keep your information up-to-date.

REVVED-UP REWARDS PROGRAM BENEFITS

We give members of the Program unique Rewards just for signing up. Members may also earn credits and/or points toward Rewards by purchasing qualifying items at participating Quaker Steak & Lube® restaurants. To receive credit and/or points for purchasing qualifying items, give your server your Program Card or your phone number when you pay for your meal. Your server will enter your Program Card or phone number in our system, and our Revved-Up Rewards system will apply the credits and/or points to which you are entitled to your Program Account. The credits and/or points you receive may depend on the specific menu items you purchase, the amount you spend (excluding sales tax, discounts, service fees, and tips), where you live, how long you have been a Member of Revved-Up Rewards, and, for certain Rewards, other factors that we will announce when we announce that the Reward is available to Members.

You can track the credits and Rewards you have already earned and view the points that you may be able to earn through purchases or promotions by logging into your Program account at TheLube.com/Rewards and entering your username and your Quaker Steak & Lube® Program account password.

A Reward may be:

  • A dollar reward (loaded value) we give you after you:
    • Visit a number of times we specify
    • Visit during a period we specify
    • Reach a point threshold we specify
    • Purchase a number of item(s) we specify
  • A free menu item we give you after you:
    • Visit a number of times we specify
    • Visit during a period we specify
    • Reach a point threshold we specify
    • Purchase a number of item(s) we specify
  • Free food or non-alcoholic drinks
  • Other things that entitle you to discounts, credits, or specific menu items

We may make certain Rewards available only while supplies last.  We may make certain Rewards available only during a certain period of time.  We may make certain Rewards available only to particular members.  The rewards and qualifying events may be changed by us at any time in our sole discretion.

QUAKER STEAK & LUBE® REVVED-UP REWARDS™

You may redeem only one earned Reward per visit to a Quaker Steak & Lube® restaurant, and you may redeem only two earned Rewards per day. You may earn credit(s) towards a particular Reward only once per visit, and you may earn credit(s) towards a particular Reward only two times per day. You may earn a maximum credit of two per day and one per visit.

Surprise & Delight Rewards

Occasionally, we may send you an e-mail notifying you that we have made a Surprise & Delight Reward available just for you.  Surprise & Delight Rewards will be limited time offers that you may redeem only during the time stated in the e-mail message we send you.  Surprise & Delight Rewards are tailored to fit your menu favorites and other interests, so we may not offer you the same Reward as we offer another Revved-Up Rewards™ Member.

$10 Sign-Up Reward

Once you receive and register your Program Card, you are automatically entitled to a $10 reward. This reward will be applied during your next visit to a participating Quaker Steak & Lube® restaurant when you present your Program Card to your server. The $10 applies to all food and non-alcoholic beverages. The $10 reward cannot be used to purchase alcoholic beverages, gift cards, and retail purchases.  The $10 sign-up reward expires 30 days after you register your Program Card.

Reward Points

Every time you visit a participating Quaker Steak & Lube® and purchase a company-designated eligible item or items (a "Qualifying Purchase"), you will receive one point on your Program Account for each dollar you spend (rounded down to the nearest full dollar) on a Qualifying Purchase. Qualifying Purchases include all pre-tax dollars spent on food and retail offerings. Dollars spent on the purchase(s) of Quaker Steak & Lube® Gift Card(s) or alcoholic beverages are not Qualifying Purchases; therefore, no reward points will be earned for dollars spent on Quaker Steak & Lube® Gift Cards or alcoholic beverages. Points are earned based on the discounted sale price of qualifying items. You will not earn points on taxes, discounts, service fees, gratuity, or tips. Members can earn points on dine-in, delivery, and to-go purchases.

Points earned will expire 365 days from the date of the purchase which earned the respective reward points.  Points will be redeemed in a FIFO (First In, First Out) method.  Thus, points will be redeemed such that oldest points will be redeem first so that you will retain the more recently earned points as you redeem them.  Points do not hold any monetary value, nor can they be redeemed for cash.  Members can earn additional bonus points by completing any Revved-Up Rewards then active challenges (“Challenges”) or other activities issues to Guest(s). Challenges will be defined by Quaker Steak & Lube® at our own discretion and may require specific actions by the Guest, including but not limited to: purchasing specific items, dining during specific periods of time, buying a specific number of items over a specific period of time, visiting during certain days, spending above a specific threshold during one visit or across a particular date range, interacting via social media, or by completing surveys. Bonus Points awarded for completing Challenges are awarded entirely at our discretion subject to the terms and conditions required for each Challenge, and may be adjusted or expired without warning. The ability to earn Points for Challenges may be capped at a specific threshold as specified in the terms of the particular Challenge. Challenges may be issued at our sole discretion. Bonus Points are valid for 365 days from date earned. Bonus points are redeemed in the FIFO method and take precedent to non-bonus points. Bonus points do not hold any monetary value, nor can they be redeemed for cash.

CHANGES TO THE PROGRAM OR REWARDS

We have the right at any time, with or without giving you prior notice, to:

  • end the Program and/or any specific Reward;
  • change any Reward or other Program benefit we offer;
  • change the requirements for earning a particular Reward;
  • change the time you have in which to earn a particular Reward; and
  • change any other feature of the Program.

If we decide to end the Program or a specific Reward, we will attempt to provide you 90-days’ prior notice either by e-mailing you at the e-mail address listed in your Program Account or by posting a notice on TheLube.com/Rewards. However, our failure to notify you that we are ending the Program or that we are ending a specific Reward plan will not give you any right to require us to continue the Program or the specific Reward after the date we end the Program or the specific Reward plan. Neither will our failure to notify you obligate us to compensate you for any Rewards or credits that you do not use before we end the Program or the specific Reward plan. Rewards and credits you accumulate under the Program have no cash value. If we end the Program, Rewards and credits you have earned but not used will expire on the end date, and you may not redeem any Rewards or use any credits after the end date.

To the extent permitted by law, when you enroll in the Program, you waive your rights under any law that may require us to obtain judicial permission to change these Rules or to end the Program.

MEMBERSHIP TERMINATION

You may cancel your Program Account at any time by sending a letter to: Quaker Steak & Lube® Revved-Up Rewards, Quaker Steak & Lube® Franchising Corp. 101 Chestnut Avenue, Sharon, PA 16146.

As soon as you cancel your Program Account, Quaker Steak & Lube® will de-activate your Program Card and you will forfeit all Rewards, credits, and other benefits of being a Quaker Steak & Lube® Program Member that you may have earned.

LIMITATION OF LIABILITY

In this Limitation of Liability section of the Rules, Quaker Steak & Lube® Franchising Corp. and its parent company, subsidiaries, their directors, officers, employees, agents, and Quaker Steak & Lube® Franchising Corp.’s franchisees and their parent companies, subsidiaries, directors, officers, employees, and agents are referred to as the "Quaker Steak & Lube® Parties." By enrolling in and participating in the Program, you agree that, to the fullest extent permitted by law, none of the Quaker Steak & Lube® Parties shall be liable to you for: (1) any claim, loss, injury, damage, delay, accident, cost or expense, including attorney’s fees, arising out of or related to the Program, these Rules, or the Program Website; (2) any incidental, indirect, special, punitive, exemplary or consequential damages, arising out of or related to the Program, these Rules, or the Website, (3) any failure, delay or decision by the Quaker Steak & Lube® Parties in administering the Program; (4) any use of your Program Card by a party that you did not authorize to use your Program Card; (5) any representation, claim, offer or statement we make about the Program; and (6) your use and acceptance of any Rewards you receive through the Program. You further agree that in no event will the Quaker Steak & Lube® Parties be liable to you for more than $25 in the aggregate on account of all wrongful acts or omissions by the Quaker Steak & Lube® ® Parties arising out of or relating to the Program.

NO WARRANTY

TO THE EXTENT ALLOWABLE BY LAW, QUAKER STEAK & LUBE® MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE PROGRAM, EITHER EXPRESS OR IMPLIED.

CUSTOMER INDEMNIFICATION

You agree to indemnify, defend and hold harmless, Quaker Steak & Lube® and Quaker Steak & Lube®’s employees, officers, directors, shareholders, agents and representatives (collectively, "QSL Indemnitees") from and against any and all liability, suits, claims and proceedings (including reasonable attorney and professional fees) resulting from your unauthorized use of the Program, your negligence, violation of law, or willful misconduct.

CONTROLLING LAW

The law of the state of Pennsylvania, without regard to its conflict of laws rules, will govern your enrollment and participation in the Program and our performance of our obligations under the Program. You and we agree to bring any action against the other party that arises out of the Program only in the state and federal courts of appropriate jurisdiction located in the state of Pennsylvania.

If applicable law prohibits us from offering the Program to you, then you may not enroll in the Program. If applicable law prohibits us from offering you a feature of the Program, then we may either not offer you that feature of the Program or cancel your membership in the Program.

CHANGES TO THE RULES

We may change these Rules from time to time as we deem appropriate, with or without providing you prior notice of the change. If we change the Rules, then the revised Rules will be substituted for these Rules on the effective date of the revised Rules. If there is a conflict between the revised Rules and these Rules, the revised Rules shall control.
